1. Background: The Federal Government of Somalia has recently passed a new data protection law - the Somali Data Protection Law (DPL) 2023 - that requires the establishment of Somali Data Protection Authority (DPA) to oversee the implementation of the law. The Authority will be the lead Federal Government body mandated to implement and enforce compliance of the DPL and formulate national regulations related to data protection and privacy.
The DPA is currently a key beneficiary of a World Bank-financed investment operation, the Somalia Capacity Advancement, Livelihoods and Entrepreneurship through Digital Uplift Project (SCALED-UP). The Project seeks to strengthen FGS’s capacity to support wider access of digital-enabled services, where ensuring that enabling legal framework is in place to support SCALED UP in digital services is seen as critical. The Project will among others seek to strengthen the Government’s capacity to manage data protection. It will help lay the foundations for safeguarding data protection in compliance with the recently passed DPL. The Data Protection Authority intends to apply part of the proceeds of the above project to finance the position of the Embedded Advisor for Project Management (Individual Consultant).
2. Responsibilities:
In supporting the DPA, the Consultant will carry out several duties, including assisting the DPA Director General in managing the overall implementation of the broader project to operationalize
the DPA, developing and implementing a detailed project work plan, monitoring and evaluating project activities, and preparing progress reports. The Consultant will oversee the procurement of goods and services required for establishing the new DPA, including developing procurement plans, preparing bidding documents, and selecting suppliers. Additionally, they will contribute to the development and implementation of a 5-year strategic plan (to be developed by a consulting firm). The Consultant will liaise with the World Bank and PIU to update and monitor the annual work plan, ensuring all project activities are implemented in accordance with the plan, that project outputs and outcomes are achieved within the specified timeframe and budget, and that any issues are addressed promptly. They will also administer the setup of the new DPA operations, including staff recruitment and selection, development of policies, procedures, and guidelines, and the design and implementation of an effective organizational structure, working closely with DPA staff, other individual consultants, and firms responsible for relevant activities and deliverables. Lastly, the Consultant will collaborate with DPA staff, PIU, other consultants engaged by the DPA, and relevant government agencies to ensure the new authority is fully integrated into the government's institutional framework. 3. Duration: The contract period will be for the duration of the SCALED-UP project with a 3-month trial period. The duty station for the assignment will be at the DPA in Mogadishu. The starting date is as soon as possible.
Skills and qualifications
3. Selection Criteria: The selection shall be based on qualification, experience and skills of the candidate and followed by an interview. The Project Manager (Consultant) should have the following qualifications and experience:
• Bachelor’s degree or equivalent in a relevant field (business administration, public administration, or law);
• At least 7 years of relevant experience, including project management type experience in the public sector and/or international organizations.
• Excellent interpersonal skills, including the ability to work both independently and effectively in a team/task force setting.
• Experience working with multiple stakeholders, including government entities, civil society organizations, local communities, and private sector;
• Familiarity and experience with the implementation of data protection frameworks and any certifications in this field would be a significant added advantage.
• Demonstrated ability to listen and integrate ideas from diverse views, create partnerships and collaborate with others, advocate, and influence, resolve conflicts constructively, and work effectively across boundaries; and
• Demonstrated ability to communicate effectively in English and Somali.
5. The Ministry of Ministry of Finance now invites eligible consulting (“Consultants”) to indicate their interest in providing the above-mentioned Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services and furnish the Curriculum Vitae (CV).
6. Attention of interested Consultants is drawn to section III, para 3.14,3.16 & 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers: Procurement in Investment Projects Financing Goods, Works, Non -Consulting and Consulting Services dated in September 2023 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
7. A Consultant will be selected in accordance with the Individual Consultant method set out in the World Bank Procurement Regulations.
